Before contacting a Notary Public, it’s important to check with the facility to confirm whether they allow visitors for notarization purposes. Jails may have specific rules in place that dictate who can enter for these services.

2. Communicate with the Inmate Ahead of Time

It’s advisable to reach out to the inmate before scheduling the Notary’s visit. This ensures that the inmate understands the purpose of the notarization and the nature of the document. Please keep in mind that Notaries cannot review or explain the contents of legal documents, as they are not authorized to give legal advice.

3. Witness Requirements for Notarization

If your document requires a witness, note that many jails will not permit jail staff to act as witnesses. This may require you to arrange for an additional witness to accompany the Notary. In such cases, the second witness is typically another Notary, as most facilities will only allow certain individuals (such as attorneys or Notaries) to enter the facility in addition to the incarcerated individual.

Notaries cannot create or draft legal documents such as Release Forms, Powers of Attorney, or Divorce Papers for inmates, unless they are also licensed Document Preparers or Attorneys. When requesting notarization, always bring the document you wish to have notarized with you.

You can either pick it up at the jail once the appointment is complete, provide a prepaid shipping label (FedEx or UPS), or cover the costs for a courier service to return the document to you.

6. Restrictions on Ink Signatures for Inmates

Some jails may prohibit inmates from using ink pens to sign documents. While this might seem concerning, it’s important to understand that no federal law mandates signatures must be in ink to be legally valid. If the facility restricts ink signatures, this is not the responsibility of the Notary. Rest assured, the Notary's signature and seal will always be applied in ink, as required by law.
